Chief Mike Ozekhome (SAN) Constitutional lawyer and human rights activist, on Thursday said Nigeria currently has no Inspector General of Police as the former occupant of the office, Mohammed Adamu is occupying the office illegally.

Speaking on Channels Television monitored by Daily Independent, Ozekhome asked President Muhammadu Buhari to rescind the decision to extend Adamu’s tenure by another three months, saying it is an abberation.

He argued that by extending Adamu’s tenure as IGP after he has retired, President Buhari is denying other qualified police personnel from rising to the zenith of their career.
“In the eye of the law, there is no Inspector-General of Police. What we have there presently is a retired Inspector General of Police illegally occupying the office”.

” Just as Ibrahim Magu had illegally occupied his office as Acting Chairman of EFCC even after he was rejected two times under Section 2 subsection 3 of the EFCC Establishment Act of 2004, based on damning report by the DSS of the same government which said he failed integrity test”.

“I can imagine some hawks, some emergency constitutional lawyers and rights activists coming out soon to say Mr Adamu can act forever as they told Magu”.

“In the eye of the law, we do not have an IGP at all because the last one has retired by a fusion of time statutorily and constitutionally. So, Mr President cannot by an administrative fiat recreate the law. The only organ that can make the law is the National Assembly under section 15 subsection 2”.
