Briyai's Resignation: We Do Not Have Power To Sack REC - INEC Clarifies Statement - Naijaextra - Entertainment Blog

The Independent National Electoral Commission (INEC) has clarified its statement on the resignation of the Resident Electoral Commissioner (REC) in Cross River State, Dr Frankland Briyai.

Amid reports that the REC was sacked, INEC’s National Commissioner and Director of Voter Education, Mr Oluwole Osaze-Uzzi, said the commission does not have the power to take such action.

He, however, explained that INEC could only delegate power, duties, and responsibilities, saying that was exactly what it did.

“I don’t think we have the power to sack a REC,” Mr Osaze-Uzzi said during an interview on Channels Television’s Politics Today on Friday.

He added, “The REC’s duty, powers, and responsibility have been delegated by the commission. What the commission just have power to do is delegate his power, delegate his duty, delegate responsibility.

“In this particular case, we have withdrawn that delegated power such that Dr Brayai no longer functions as the REC of Cross River State. He has said he has even resigned anyway.”

On Thursday, Dr Briyai addressed reporters in Calabar, where he declared to contest for the governorship election in Bayelsa State.

He also announced his resignation as a Resident Electoral Commissioner, saying he would run on the platform of the All Progressives Congress (APC) in the November 16 poll.

In a statement, INEC said it has yet to receive any resignation letter from the REC, in line with the provisions of the Constitution.

According to the commission, Dr Briyai failed to follow laid down procedure for resignation as such can only take effect on receipt of the resignation letter by the appointing authority.

It also condemned the use of the premises of the electoral body for expression of political interest, saying it was unlawful.

INEC, thereafter, directed its administrative secretary in Cross River to take over the responsibilities of the REC until further notice.
